1. General Provisions
1.1. These "Rules for the Provision of Hotel Services at Statsky Sovetnik LLC", category 3 (Three) stars, (hereinafter referred to as the "Rules") have been developed in accordance with the Decree of the Government of the Russian Federation dated November 18, 2020 No. 1853 "On Approval of the Rules for the Provision of Hotel Services in the Russian Federation" in order to determine the procedure and terms for the provision of hotel services. The Rules apply to Guests staying at the Hotel, as well as to counterparties when they conclude contracts with the Contractor, including the provision of services, agency agreements, and are an integral part of these contracts.
1.2. The main concepts used in these Rules mean:
"Hotel" - "Statsky Sovetnik" - a hotel intended for the provision of temporary accommodation services and other related services;
"Consumer" ("Guest") - an individual intending to order or ordering and using hotel services exclusively for personal, family, household and other needs not related to entrepreneurial activity;
"Hotel services" (hereinafter referred to as "Services") - a set of actions to ensure the temporary accommodation of the Guest at the Hotel, performed by the Contractor in the interests of the Guest and at the request of the Guest or the Customer, including the main and additional Services provided to the Guest;
"Contractor" - LLC "Statsky Sovetnik", providing services to Guests under a service agreement, fulfilling obligations under an agency agreement and other agreements;
"Customer" - a person who has applied to the Contractor with an order and orders Services in favor of the Guest, as a third party. Legal entities, individual entrepreneurs and individuals may act as the Customer.
"Reservation" - preliminary booking of places and (or) rooms in the Hotel by the Customer or Consumer (Guest).
1.3. The Hotel operates around the clock.
1.4. The time specified in the Rules is the local time of the Hotel and corresponds to Moscow time UTC (SU) +3.
2. Information about services, procedure for booking and paying for services
2.1. Services are provided in accordance with the current price list and the mode of provision of Services.
2.2. The Contractor reserves the right to change the price list and other conditions for the provision of Services without prior notice, unless this is prohibited by the current legislation of the Russian Federation.
2.3. Booking is made subject to the possibility of providing the Service, and also subject to the provision of sufficient and necessary information by the booking party, and its consent to these Rules.
2.4. The agreement for booking places in the Hotel is concluded between the Customer or Guest and the Contractor by drawing up a document signed by both parties, as well as by accepting a booking application via mail, telephone or other communication that makes it possible to reliably establish that the application comes from the Customer or Guest.
2.5. Confirmation of the booking is made by the Contractor by notifying the Customer or Guest in any written form; the notification must contain the order confirmation number.
2.6. Booking may be guaranteed or non-guaranteed.
2.7. In case of non-guaranteed booking, no advance payment for the Services is made. The Guest may cancel a non-guaranteed booking at any time without penalty. A non-guaranteed booking may be cancelled if the Guest fails to arrive by 16:00 on the day of arrival.
In case of the Guest's arrival after the non-guaranteed booking cancellation period has expired, the Service is provided subject to availability and under the current terms of its provision. The Contractor shall not be liable for failure to provide the Service to the Guest, or for providing the Service to the Guest under other terms.
2.8. In case of guaranteed booking, the Guest makes a mandatory advance payment or guarantees payment for the Services by credit card or cash in the currency of the Russian Federation (in rubles), in full or in part (but not less than 100% of the cost of the first night's stay at the Hotel), with subsequent payment of the remaining part of the cost of the Services upon arrival.
The Hotel reserves the Guest's guaranteed (paid) room until 12:00 local time on the day following the Guest's scheduled arrival. The Hotel reserves the right to verify the bank card provided by the Guest as a guarantee of the reservation at any time after the Guest has completed the reservation, by means of a preliminary authorization transaction in the amount equal to the cost of the first night's stay.
2.9. The booking configuration may be changed before and/or after the Guest's check-in, subject to availability and taking into account the terms and restrictions on making such changes established by the Contractor.
2.10. Payment for the Services provided by the Hotel is made according to the current price list. The current price list for the Services is available at the Hotel's reception desk, as well as on the Contractor's website www.wawelberg.com and in the Contractor's sales department.
2.11. Payment for Services is accepted in Russian rubles by cash or bank transfer.
2.12. No fee is charged for children under 12 staying in a room with their parents.
2.13. For the provision of an extra bed in the Hotel room, including for children aged 12 and over, a fee is charged in accordance with the current Hotel Price List for additional services not included in the cost of accommodation, posted in the Consumer Corner of the Hotel, as well as on the official website of the Hotel.
2.14. For the accommodation of other persons in the Guest's room, with the exception of those specified in paragraph 2.12 of the Rules, a fee is charged in accordance with the current price list.
2.15. The established check-in time at the Hotel depends on the room category booked by the Guest.
The established check-in time at the Hotel for a Deluxe room (deluxe with an atrium view, deluxe with a city view with one or two beds) is 16:00 of the current day. In this case, a day is calculated from 16:00 of the current day to 13:00 of the next day.
The established check-in time at the Hotel for all other room categories is 15:00 of the current day. In this case, a day is calculated from 15:00 of the current day to 12:00 of the next day.
A guaranteed check-in before the established check-in time at the Hotel, as agreed in advance by the Hotel and the Guest, based on the advance booking specified in this clause, is paid for in the following order:
- when checking into a Deluxe room (Deluxe with an atrium view, Deluxe with a city view with one or two beds) before 09:00, a payment of 100% of the cost of accommodation in the corresponding room per day is charged,
- when checking into a Deluxe room (Deluxe with an atrium view, Deluxe with a city view with one or two beds) from 09:00 to 16:00, a payment of 50% of the cost of accommodation (minus the cost of breakfast(s)) in the corresponding room per day is charged. If breakfast(s) is required on the day of arrival, its cost is added to the cost of early arrival,
- when checking in to rooms of other categories before 08:00, a payment of 100% of the cost of accommodation in the corresponding room per day is charged,
- when checking in to rooms of other categories from 08:00 to 15:00, a payment of 50% of the cost of accommodation (minus the cost of breakfast(s)) in the corresponding room per day is charged. If breakfast(s) is required on the day of arrival, its cost is added to the cost of early arrival.
Subject to availability and available cleaned Deluxe rooms (Deluxe Atrium View, Deluxe City View with one or two beds), check-in until 16:00 is permitted without prior approval. Subject to availability and available cleaned rooms of other categories, check-in until 15:00 is permitted without prior approval.
The period of stay (night stay) is calculated for Deluxe rooms (Deluxe Atrium View, Deluxe City View with one or two beds) from 16:00 on one day (the established check-in time at the Hotel) to 13:00 on another day (check-out time for Deluxe rooms), and for rooms of other categories - from 15:00 on one day (the established check-in time at the Hotel) to 12:00 on another day (check-out time for other room categories). At the end of the paid period of stay, the Guest is obliged to vacate the Deluxe room by 13:00, and the room of other categories by 12:00.
In case of check-out from the Deluxe room (Deluxe with atrium view, Deluxe with city view with one or two beds) after 12:00, payment for accommodation is charged as follows:
- for check-out from 13:00 to 19:00, 50% of the cost of accommodation in the corresponding room per day is charged;
- for check-out after 19:00, 100% of the cost of accommodation in the corresponding room per day is charged.
In case of check-out from rooms of other categories after 12:00, payment for accommodation is charged as follows:
- for check-out from 12:00 to 18:00, 50% of the cost of accommodation in the corresponding room per day is charged;
- upon check-out after 18:00, 100% of the cost of accommodation in the corresponding room per day is charged.
If the Guest wishes to extend the period of stay, it is necessary to inform the Hotel administrator no later than 12 hours before the end of the corresponding check-out time. The period of stay can be extended only if there is no reservation for this room. If there are available rooms, the Guest can be provided with another room.
Early check-in without prior booking and approval (from 00:00 to 15:00 on the day of arrival) is possible only if there are available places and is paid as follows:
- upon check-in before 03:00, a payment of 100% of the cost of one night's stay is charged
- upon check-in from 03:00 to 15:00, a payment of 50% of the cost of one night's stay is charged
3. Procedure for registering accommodation at the Hotel
3.1. When registering accommodation, the Guest - a citizen of the Russian Federation provides documents in accordance with paragraph No. 18 of the Rules for the provision of hotel services, approved by the Decree of the Government of the Russian Federation of November 18, 2020 No. 1853, as well as documents confirming the fact of booking and (or) payment for the room.
3.2. Registration of accommodation for a minor is carried out in accordance with paragraph No. 18 of the Rules for the Provision of Hotel Services, approved by the Decree of the Government of the Russian Federation dated November 18, 2020 No. 1853.
3.3. When registering accommodation, a Guest - a foreign citizen (stateless person) provides an identity document, a visa (if any, including if there is a visa that is not affixed to the foreign citizen's identity document), a migration card (for a foreign citizen temporarily staying in the Russian Federation) and (or) a residence permit or temporary residence permit (for a foreign citizen permanently or temporarily residing in the Russian Federation). In case of arrival at a new place of stay, a tear-off part of the notification of arrival at the previous place of stay in the Russian Federation is additionally presented. 3.4. When registering for accommodation, the Guest (except for persons under 14 years of age) fills out a registration card of the established form, which is also an agreement on the provision of hotel services - in 2 (two) copies, signed by two parties: the Contractor and the Guest.
3.5. The Contractor has the right to refuse accommodation and provision of services to persons under the influence of alcohol or drugs.
3.6. Guests with pets are not allowed to stay at the Hotel.
3.7. At the request of the Guests, with the mutual consent of the Hotel Administration and the staying Guest, strangers are allowed to stay in the room from 8:00 to 23:00 on the basis of an identity document of the visitor. The Guest must personally confirm consent to the visit by meeting the visitor at the reception desk and providing the necessary documents.
After 23:00 hours, the further stay of outsiders in the Hotel is possible only on condition of their registration in the Guest's room (if the room category allows for sharing and the maximum number of guests staying is not exceeded), or payment for another room (if there are available rooms).
This procedure is a security measure aimed at ensuring the safety of Guests, the safety of the property of the Hotel and Guests, as well as the fulfillment of the Contractor's obligation established by law to register citizens at the place of stay.
In case of violation of the procedure for the stay of outsiders in the Hotel after 23:00 hours, established by paragraph 2 of clause 3.7. of the Rules, a fine of 20,000 (twenty thousand) rubles is imposed on the staying Guest.
3.8. The Guest gives his consent to the processing of his personal data and their transfer to third parties by the Contractor in cases stipulated by the current legislation of the Russian Federation.
3.9. The Contractor ensures the confidentiality of the Guest's personal data and guarantees that the transfer of his personal data to third parties will be carried out only for the purposes stipulated by the current legislation of the Russian Federation.
3.10. The following persons have the right to priority service:
·Heroes of Socialist Labor;
·Full Cavaliers of the Order of Labor Glory (Articles 1.1, 5 of the Federal Law of 09.01.1997 No. 5-FZ "On the Provision of Social Guarantees to Heroes of Socialist Labor and Full Cavaliers of the Order of Labor Glory");
·War invalids (subparagraph 28 of paragraph 1 of Article 14 of the Federal Law of 12.01.1995 No. 5-FZ "On Veterans");
·Participants of the Great Patriotic War (subparagraph 19 of paragraph 1 of Article 15 of the Federal Law of 12.01.1995 No. 5-FZ);
·Persons awarded the "Resident of Blockaded Leningrad" badge (subparagraph 15 of paragraph 1 of Article 18 of the Federal Law of 12.01.1995 No. 5-FZ);
·Heroes of the Soviet Union;
·Heroes of the Russian Federation;
· full holders of the Order of Glory (Article 1.1, 7 of the Law of the Russian Federation of 15.01.1993 No. 4301-1 "On the Status of Heroes of the Soviet Union, Heroes of the Russian Federation and Full Holders of the Order of Glory")
· disabled persons of groups I and II (paragraph 6 of clause 1 of the Decree of the President of the Russian Federation of 02.10.1992 No. 1157)
4. Rights and obligations of the Hotel Guest
4.1. The Hotel Guest is obliged to:
· comply with these Rules;
· not disturb other Hotel Guests, maintain silence and public order in the room, premises and on the territory of the Hotel;
· treat the property of the Hotel with care, keep the room, premises and on the territory of the Hotel clean;
· comply with fire safety rules;
· immediately inform any employee of the Hotel if signs of an emergency condition of plumbing, electrical or other equipment are detected;
· promptly and in full pay for the Services provided by the Hotel;
· compensate for damage in case of loss of or damage to the property of the Hotel;
· inform the Hotel employees making the reservation - when booking hotel services, or the Hotel employees arranging the Guest's stay - when arranging the stay - of any possible allergic reactions before or during check-in at the Hotel. · in case of shortening the length of stay and early departure of the Guest from the Hotel, the Guest must notify the Hotel accommodation service administrator at least 24 hours before departure. If the Guest violates the specified notice period for early departure, the Hotel will charge a fee of 100% of the cost of the night following departure.
4.2. The Hotel Guest is prohibited from:
· leaving strangers in the room in his/her absence, as well as giving them the key to the room;
· removing hotel property from the room;
· storing bulky items, weapons, ammunition, explosives, chemical, radioactive and toxic substances, explosive devices, narcotic and psychotropic substances, other items that threaten public safety and order in the room;
· moving furniture and equipment in the room and the premises of the Hotel;
· smoking in the room, in the premises and on the territory of the Hotel. In accordance with subparagraph 5 of paragraph 5 of Article 12 of the Federal Law of 23.02.2013 No. 15-FZ "On the Protection of Citizens' Health from the Effects of Second-Hand Tobacco Smoke and the Consequences of Tobacco Consumption", smoking tobacco is prohibited in premises intended for the provision of hotel services. A penalty (fine) in the amount of 30,000 (thirty thousand) rubles 00 kopecks shall be charged upon a justified request of the Contractor.
4.3. In the event of a violation by the Guest of paragraphs 4.1, 4.2 of these Rules, the Contractor has the right to terminate the provision of Services unilaterally.
4.4. The Guest has the right to terminate the contract for the provision of services at any time, taking into account paragraph 10 of paragraph 4.1 of these Rules and payment to the Contractor for the cost of the Services actually rendered.
4.5. The Guest acknowledges and does not object to the use of video surveillance systems in the premises and on the territory of the Hotel (except for residential rooms and toilet cabins).
5. Rights and obligations of the Contractor
5.1. The Contractor ensures the quality of the Services provided in accordance with the terms of the service agreement, including the one concluded with the Guest by the agent on the basis of the agency agreement, and in the absence of the above agreements - in accordance with the requirements usually imposed on these services.
5.2. The Contractor is obliged to ensure the placement of information provided for in paragraphs 9, 10 of the Rules for the Provision of Hotel Services in the Russian Federation, approved by the Decree of the Government of the Russian Federation dated November 18, 2020 No. 1853.
5.3. The Hotel Administration has the right to replace the room provided to the Guest and demand immediate vacancy of the room occupied by the Guest in case of the need to carry out emergency repair and technical, sanitary and epidemiological and other work aimed at eliminating the causes that create a threat or hinder the high-quality and safe provision of Services.
5.4. The Hotel Administration has the right to refuse the Guest the provision of Services and evict the Guest from the Hotel in the event of a violation of these Rules, late payment for the Services provided by the Hotel, as well as the commission (attempt to commit) by the Guest against the Hotel staff and (or) other Hotel Guests of illegal actions that threaten the safety of life, health, honor, dignity and (or) property of other persons.
5.5. The Hotel Administration reserves the right to access the room without prior agreement with the Guest in the event of an emergency, as well as in the event of a violation of these Rules or public order by the Guest.
6. Other conditions
6.1. The Contractor shall not be liable for material and (or) moral damage caused to the Guest due to reasons beyond the control of the Contractor.
6.2. The Contractor shall not be liable for the property of the Guest left in the common areas of the Hotel. 6.3. The Contractor shall not be liable for the Guest's health if the Guest, in accordance with paragraph 9 of clause 4.1. of these Rules, has not informed the Hotel employees making the reservation or arranging the stay, of their possible allergic reactions.
6.4. In the event of detection of deficiencies in the provision of Services, the Guest must immediately notify the Contractor. If it is impossible to eliminate the deficiencies, the Guest must state their claims in writing. Failure to comply with this condition may serve as grounds for full or partial refusal to satisfy the claim.
6.5. In the event that the Guests are sent to the Hotel by the Customer, the Customer is directly responsible for the accuracy of the information related to these Rules.
6.6. These Rules for the Provision of Hotel Services in Statsky Sovetnik LLC are an official offer.
